In short: This website sets no cookies, uses no analytics or tracking, embeds no third-party content and loads its fonts from our own server. We only process the data that is technically necessary to show you the site, and the data you send us yourself.

1. Controller

The controller within the meaning of the General Data Protection Regulation (GDPR) is the provider named in our imprint, trading as Ombrez. Email: tradingxsucks@gmail.com. We have not appointed a data protection officer because we are not required to.

2. Hosting and server logs

This website is hosted by Netlify, Inc., 101 2nd Street, San Francisco, CA 94105, USA. When you open a page, your browser automatically transmits data that Netlify processes on our behalf: IP address, date and time of the request, the page requested, the referring page, browser type and operating system. This is technically necessary to deliver the website and to protect it against attacks. We do not access or store these logs ourselves. Netlify keeps them only as long as needed for operation and security.

Legal basis: Art. 6 (1) (f) GDPR (our legitimate interest in a secure and working website). Netlify processes the data as our processor under a data processing agreement. Netlify, Inc. is certified under the EU-U.S. Data Privacy Framework, for which the European Commission has adopted an adequacy decision (Art. 45 GDPR). More: netlify.com/privacy.

3. No cookies, no tracking

We do not use cookies, analytics tools, advertising pixels, social media plugins or embedded videos. The fonts are stored on our own server, so no request is sent to Google or any other font provider. The risk calculator on the main page runs entirely in your browser. Nothing you enter there is sent to us.

4. Contact by email or Instagram

If you write to us by email or Instagram direct message, we process the data you send (for example your name or username, your address or profile and your message) to answer your request. Legal basis: Art. 6 (1) (b) GDPR if your request relates to a contract or a planned purchase, otherwise Art. 6 (1) (f) GDPR (our interest in answering enquiries). Our email account runs on Gmail, a service of Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland. Google processes the emails under its own privacy policy (policies.google.com/privacy). Data may be transferred to Google LLC in the USA, which is certified under the EU-U.S. Data Privacy Framework. For Instagram messages, Meta’s privacy policy also applies.

5. Purchases via Whop

Ombrez is sold through the platform Whop (Whop, Inc., 300 Kent Ave #401, Brooklyn, NY 11249, USA). When you buy, you enter your data on Whop’s checkout. Whop processes payment and account data under its own responsibility. Its privacy policy applies: whop.com/privacy.

From Whop we receive the data we need to fulfil the contract: your name or username, email address, country, the product you bought, the subscription status and your licence key. We use it to provide the software, the licence and support (Art. 6 (1) (b) GDPR) and to meet our tax and accounting obligations (Art. 6 (1) (c) GDPR).

6. The Ombrez software

The Ombrez indicators run on your own computer or VPS. Its settings, state files, journal and screenshots are stored locally in your MetaTrader data folder. We have no access to them.

7. Withdrawal form

If you use the withdrawal function, we process the data you enter (name, email address, the contract concerned, order or membership ID, purchase date, optional message) together with the date and time of receipt, in order to handle your withdrawal and to confirm its receipt. The form is processed by Netlify (see section 2) as our processor. Legal basis: Art. 6 (1) (c) GDPR in conjunction with §§ 11 and 13a of the Austrian Distance and Off-Premises Contracts Act (FAGG), and Art. 6 (1) (b) GDPR. We delete the submission in Netlify once the withdrawal has been handled and keep a record of it for three years.

8. Custom bot applications and projects

If you apply for a custom bot through the form on our website, we process the data you enter (name, email address, platform, markets, where the bot will trade, the status of your rules, budget, whether you apply as a private person or a business, your strategy description and the options you tick) to assess your request, contact you and prepare a quote. The form is processed by Netlify (section 2) as our processor, and we receive the submission by email (section 4). If a project follows, we also process the information, files and code you send us and the contract and invoice data. If we hold a video call, we use a service agreed with you, for example Google Meet; its privacy policy applies. We do not record calls.

Legal basis: Art. 6 (1) (b) GDPR (steps before a contract and performance of the contract) and Art. 6 (1) (c) GDPR (tax and accounting obligations). We treat your strategy as confidential and give it to nobody apart from the service providers named here (Netlify as our processor, Google for email and, if agreed, video calls). Applications that do not lead to a project are deleted within six months. Project data and code are kept as long as we owe warranty or support and until claims are time-barred, generally three years after the project ends (Art. 6 (1) (f) GDPR, defence of legal claims); invoices for seven years.

9. Our Instagram profile

We run a business profile on Instagram (@xombrez), operated by Meta Platforms Ireland Ltd., Merrion Road, Dublin 4, Ireland. When you visit the profile, Meta processes your data and provides us with anonymised statistics (Insights). For this processing we and Meta are joint controllers (Art. 26 GDPR). Meta has assumed primary responsibility under the Page Insights Controller Addendum. You can exercise your rights directly with Meta. More: Instagram privacy policy. Legal basis: Art. 6 (1) (f) GDPR (our interest in communicating with our community).

10. External links

Our website contains links, for example to Whop, Instagram, FTMO or the sources we quote. No data is transmitted to these providers until you click a link. After that, their privacy policies apply.

11. Retention

We delete personal data as soon as it is no longer needed for the purpose for which it was collected. Messages are deleted at the latest three years after the last contact. Data relevant to tax and accounting is kept for seven years (§ 132 Austrian Federal Fiscal Code, BAO), or ten years where required for the EU One-Stop-Shop (OSS). Withdrawal declarations are kept for three years so that we can prove how they were handled. For custom bot applications and projects, see section 8.

12. Your rights

You have the right to access, rectification, erasure, restriction of processing, data portability and to object to processing based on Art. 6 (1) (f) GDPR (Art. 15–21 GDPR). To exercise them, write to tradingxsucks@gmail.com.

You also have the right to lodge a complaint with a supervisory authority. In Austria this is the Datenschutzbehörde, Barichgasse 40–42, 1030 Vienna, www.dsb.gv.at, dsb@dsb.gv.at.

We do not use automated decision-making or profiling within the meaning of Art. 22 GDPR. The website is delivered exclusively via encrypted HTTPS connections.

13. Changes

We will update this privacy policy if our website or the law changes. The current version is always available on this page.

2. Hosting und Server-Logs

Diese Website wird bei Netlify, Inc., 101 2nd Street, San Francisco, CA 94105, USA, gehostet. Beim Aufruf einer Seite übermittelt dein Browser automatisch Daten, die Netlify in unserem Auftrag verarbeitet: IP-Adresse, Datum und Uhrzeit, aufgerufene Seite, verweisende Seite, Browsertyp und Betriebssystem. Das ist technisch nötig, um die Website auszuliefern und vor Angriffen zu schützen. Wir greifen auf diese Logs nicht zu und speichern sie nicht selbst. Netlify bewahrt sie nur so lange auf, wie es für Betrieb und Sicherheit nötig ist.

Rechtsgrundlage: Art. 6 Abs. 1 lit. f DSGVO (berechtigtes Interesse an einer sicheren und funktionierenden Website). Netlify verarbeitet die Daten als Auftragsverarbeiter auf Grundlage eines Auftragsverarbeitungsvertrags. Netlify, Inc. ist nach dem EU-U.S. Data Privacy Framework zertifiziert, für das ein Angemessenheitsbeschluss der EU-Kommission besteht (Art. 45 DSGVO). Mehr: netlify.com/privacy.

3. Keine Cookies, kein Tracking

Wir verwenden keine Cookies, keine Analyse-Tools, keine Werbe-Pixel, keine Social-Media-Plugins und keine eingebetteten Videos. Die Schriften liegen auf unserem eigenen Server, es wird also keine Anfrage an Google oder einen anderen Schriften-Anbieter gesendet. Der Risiko-Rechner auf der Startseite läuft vollständig in deinem Browser. Deine Eingaben werden nicht an uns übertragen.

4. Kontakt per E-Mail oder Instagram

Wenn du uns per E-Mail oder Instagram-Direktnachricht schreibst, verarbeiten wir die übermittelten Daten (etwa Name oder Nutzername, Adresse oder Profil und Nachricht), um deine Anfrage zu beantworten. Rechtsgrundlage: Art. 6 Abs. 1 lit. b DSGVO, wenn die Anfrage mit einem Vertrag oder geplanten Kauf zusammenhängt, sonst Art. 6 Abs. 1 lit. f DSGVO (Interesse an der Beantwortung von Anfragen). Unser E-Mail-Postfach läuft über Gmail, einen Dienst der Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Irland. Google verarbeitet die E-Mails nach seiner eigenen Datenschutzerklärung (policies.google.com/privacy). Dabei können Daten an Google LLC in den USA übermittelt werden, die nach dem EU-U.S. Data Privacy Framework zertifiziert ist. Für Instagram-Nachrichten gilt zusätzlich die Datenschutzerklärung von Meta.

5. Käufe über Whop

Ombrez wird über die Plattform Whop (Whop, Inc., 300 Kent Ave #401, Brooklyn, NY 11249, USA) verkauft. Beim Kauf gibst du deine Daten im Checkout von Whop ein. Whop verarbeitet Zahlungs- und Kontodaten in eigener Verantwortung. Es gilt die Datenschutzerklärung von Whop: whop.com/privacy.

Von Whop erhalten wir die Daten, die wir zur Vertragserfüllung brauchen: Name oder Nutzername, E-Mail-Adresse, Land, gekauftes Produkt, Abo-Status und Lizenzschlüssel. Wir nutzen sie, um Software, Lizenz und Support bereitzustellen (Art. 6 Abs. 1 lit. b DSGVO) und um steuer- und unternehmensrechtliche Pflichten zu erfüllen (Art. 6 Abs. 1 lit. c DSGVO).

6. Die Ombrez-Software

Die Ombrez-Indikatoren laufen auf deinem eigenen Computer oder VPS. Einstellungen, Statusdateien, Journal und Screenshots werden lokal in deinem MetaTrader-Datenordner gespeichert. Wir haben darauf keinen Zugriff.

7. Widerrufsformular

Wenn du die Widerrufsfunktion nutzt, verarbeiten wir deine Eingaben (Name, E-Mail-Adresse, betroffener Vertrag, Bestell- oder Mitgliedschafts-ID, Kaufdatum, optionale Nachricht) zusammen mit Datum und Uhrzeit des Eingangs, um deinen Widerruf abzuwickeln und den Eingang zu bestätigen. Das Formular wird von Netlify (siehe Punkt 2) als Auftragsverarbeiter verarbeitet. Rechtsgrundlage: Art. 6 Abs. 1 lit. c DSGVO in Verbindung mit §§ 11 und 13a FAGG sowie Art. 6 Abs. 1 lit. b DSGVO. Wir löschen die Eingabe bei Netlify nach Abwicklung des Widerrufs und bewahren einen Nachweis drei Jahre auf.

8. Bewerbungen und Projekte für individuelle Bots

Wenn du dich über das Formular auf unserer Website für einen individuellen Bot bewirbst, verarbeiten wir deine Eingaben (Name, E-Mail-Adresse, Plattform, Märkte, wo der Bot handeln soll, Stand deiner Regeln, Budget, ob du dich als Privatperson oder Unternehmen bewirbst, deine Strategiebeschreibung und die angekreuzten Optionen), um deine Anfrage zu prüfen, dich zu kontaktieren und ein Angebot zu erstellen. Das Formular wird von Netlify (Punkt 2) als Auftragsverarbeiter verarbeitet, die Eingabe erhalten wir per E-Mail (Punkt 4). Kommt ein Projekt zustande, verarbeiten wir zusätzlich die Informationen, Dateien und den Code, die du uns schickst, sowie Vertrags- und Rechnungsdaten. Führen wir ein Videogespräch, nutzen wir einen mit dir vereinbarten Dienst, etwa Google Meet; es gilt dessen Datenschutzerklärung. Gespräche zeichnen wir nicht auf.

Rechtsgrundlage: Art. 6 Abs. 1 lit. b DSGVO (vorvertragliche Maßnahmen und Vertragserfüllung) und Art. 6 Abs. 1 lit. c DSGVO (steuer- und unternehmensrechtliche Pflichten). Wir behandeln deine Strategie vertraulich und geben sie niemandem außer den hier genannten Dienstleistern (Netlify als Auftragsverarbeiter, Google für E-Mail und gegebenenfalls Videogespräche). Bewerbungen ohne Projekt löschen wir binnen sechs Monaten. Projektdaten und Code bewahren wir auf, solange wir Gewährleistung oder Support schulden und bis Ansprüche verjährt sind, in der Regel drei Jahre nach Projektende (Art. 6 Abs. 1 lit. f DSGVO, Abwehr von Rechtsansprüchen); Rechnungen sieben Jahre.

9. Unser Instagram-Profil

Wir betreiben ein Unternehmensprofil auf Instagram (@xombrez), einem Dienst der Meta Platforms Ireland Ltd., Merrion Road, Dublin 4, Irland. Beim Besuch des Profils verarbeitet Meta deine Daten und stellt uns anonymisierte Statistiken (Insights) bereit. Dafür sind wir und Meta gemeinsam Verantwortliche (Art. 26 DSGVO). Meta hat im Page Insights Controller Addendum die primäre Verantwortung übernommen. Deine Rechte kannst du direkt bei Meta geltend machen. Mehr: Datenschutzrichtlinie von Instagram. Rechtsgrundlage: Art. 6 Abs. 1 lit. f DSGVO (Interesse an der Kommunikation mit unserer Community).

Unsere Website enthält Links, etwa zu Whop, Instagram, FTMO oder zu zitierten Quellen. Erst wenn du einen Link anklickst, werden Daten an den jeweiligen Anbieter übertragen. Danach gilt dessen Datenschutzerklärung.

11. Speicherdauer

Wir löschen personenbezogene Daten, sobald sie für den Zweck, für den sie erhoben wurden, nicht mehr nötig sind. Nachrichten löschen wir spätestens drei Jahre nach dem letzten Kontakt. Steuer- und buchhaltungsrelevante Daten bewahren wir sieben Jahre auf (§ 132 BAO), bei Nutzung des EU-One-Stop-Shops (OSS) zehn Jahre. Widerrufserklärungen bewahren wir drei Jahre auf, um ihre Abwicklung nachweisen zu können. Für Bewerbungen und Projekte für individuelle Bots siehe Punkt 8.

12. Deine Rechte

Du hast das Recht auf Auskunft, Berichtigung, Löschung, Einschränkung der Verarbeitung, Datenübertragbarkeit und Widerspruch gegen Verarbeitungen auf Grundlage von Art. 6 Abs. 1 lit. f DSGVO (Art. 15–21 DSGVO). Schreib uns dazu an tradingxsucks@gmail.com.

Du kannst dich außerdem bei einer Aufsichtsbehörde beschweren. In Österreich ist das die Datenschutzbehörde, Barichgasse 40–42, 1030 Wien, www.dsb.gv.at, dsb@dsb.gv.at.

Eine automatisierte Entscheidungsfindung oder Profiling im Sinne von Art. 22 DSGVO findet nicht statt. Die Website wird ausschließlich über verschlüsselte HTTPS-Verbindungen ausgeliefert.
